Amista Vineyards Wine Club Membership Terms & Conditions
Effective Date: July 1, 2025
By joining the Amista Vineyards Wine Club, you agree to the following terms and conditions. These terms govern your membership, including wine shipments, billing, cancellation, and your rights and obligations as a member.
- Membership Enrollment and Benefits
Your member benefits begin immediately upon purchase of your initial wine club selection. As a member, you will receive exclusive access to our wines, special pricing, and other benefits as outlined in your specific club level. We hope you’ll remain a part of our Amista family for many years to come.
- Automatic Renewal and Billing – IMPORTANT CALIFORNIA CONSUMER NOTICE
Your Amista Vineyards Wine Club membership is an automatic renewal service. By signing up, you explicitly acknowledge and provide your express affirmative consent that your membership will automatically renew at the end of each shipment cycle (as determined by your club level, e.g., quarterly, biannually). Your credit card on file will be automatically charged for subsequent wine club orders, applicable taxes, shipping, and any California Redemption Value (CRV) fees (for CA residents).
This is a continuous service that will remain in effect until you cancel your membership in accordance with these terms.
- Clear and Conspicuous Disclosures: Before your subscription or purchasing agreement is fulfilled, and in visual proximity to the request for your consent, we will clearly and conspicuously disclose:
- A statement that your subscription will continue automatically at the frequency of your chosen club level until you cancel.
- A description of our cancellation policy, as detailed in Section 4 below.
- The recurring charges, which will include the cost of the wine club shipment, applicable sales tax, shipping fees, and California Redemption Value (CRV) fees (for CA residents). The specific amount of the charge may vary based on the wines included in each shipment, changes in tax rates, shipping costs, or CRV rates.
- By joining, you authorize Amista Vineyards to select your wines and automatically charge your credit card for these recurring club orders.
- Express Affirmative Consent: Your action of completing the sign-up process for the wine club constitutes your express affirmative consent specifically to these automatic renewal and continuous service offer terms. We will not include any information in the contract that interferes with, detracts from, contradicts, or otherwise undermines your ability to provide this affirmative consent. We will maintain verification of your affirmative consent for at least three (3) years, or one (1) year after your contract is terminated, whichever period is longer.
- Acknowledgment: Upon your initial enrollment, you will receive an email confirmation that includes this automatic renewal offer terms, details of your membership, and clear information regarding how to cancel. Please retain this acknowledgment for your records.
- Membership Communications & Reminders
- Annual Automatic Renewal Reminder (California ARL Requirement): For all active memberships, we will send you an annual reminder via email (the same medium used for your original acknowledgment or regular communication) that clearly and conspicuously discloses:
- The product or service to which the automatic renewal or continuous service applies (e.g., “Amista Vineyards Wine Club Membership”).
- The frequency and number of charges associated with your automatic renewal.
- The means to cancel the automatic renewal or continuous service.
- Upcoming Shipment Notification (Customer Service / Operational): In addition to the annual automatic renewal reminder, for your convenience and to allow for personalization, we will send you an email reminder at least two (2) weeks prior to an upcoming shipment being processed and charged. This reminder will include:
- Details of the wines included in your upcoming shipment.
- Information on how to skip that specific shipment.
- Information on how to cancel your overall membership.
- Information on how to customize your upcoming shipment (if this is an option you offer).
- Cancellation Policy
We understand that circumstances may change. You may cancel your Amista Vineyards Wine Club membership at any time, subject to the following conditions:
- Minimum Shipment Requirement: You may cancel your membership after receiving four (4) club shipments without incurring an early cancellation fee.
- Early Cancellation Fee: If you choose to cancel your membership prior to receiving four (4) club shipments, an early cancellation fee of $125.00 will be charged to your credit card on file. This fee covers administrative costs and discounts received during your abbreviated membership.
- How to Cancel: We strive to make cancellation as easy as enrollment. You may cancel or terminate your membership by:
- Telephone: Contact us at 707.431.9200 during normal business hours. Our representatives will answer promptly and not obstruct or delay your ability to cancel. You may state your intent to cancel at any time during the call to complete the cancellation process. We may offer you a discount or other consumer benefits, or inform you of the effect of cancellation, but you will remain able to cancel the service.
- Email: Send an email to: club@amistavineyards.com. We will confirm your cancellation via email once processed.
- Online Cancellation (for online enrollments): If you enrolled in the wine club online, you may also cancel your membership exclusively online by logging into your account on our website and following the clear and straightforward cancellation prompts. This option allows you to terminate your automatic renewal at will, and the online cancellation mechanism will be prominently displayed and as easy to use as the enrollment process.
- Skipping Shipments
We offer our members the opportunity to skip up to one (1) club shipment per calendar year without penalty, provided you notify us at club@amistavineyards.com at least 10 days prior to the scheduled billing date of the shipment you wish to skip.
- Membership Information Updates
It’s your responsibility to keep your billing and shipping information current. Please update your account online or notify us promptly of any changes to your credit card details, billing address, or shipping address to avoid delays or additional charges. Amista Vineyards is not responsible for additional shipping charges or returned shipments due to outdated information.
- California Redemption Value (CRV)
For California Residents Only: As of July 1, 2025, wine containers shipped to California consumers are subject to the California Beverage Container Recycling and Litter Reduction Act. This means that:
- A California Redemption Value (CRV) fee will be applied to each applicable wine container in your club shipment. This fee will be clearly itemized on your invoice.
- This CRV fee is paid by you at the time of purchase and is intended to be redeemed by you when you recycle the empty containers at a certified recycling center in California.
- All wine bottles/containers in your shipments, if shipped on or after July 1, 2025, will bear the “CA CRV” labeling as required by California law.
- Age Verification and Delivery
By signing up for our club, you represent and guarantee that you are at least 21 years of age.
- All wine shipments must be received and signed for by an adult 21 years of age or older.
- The shipping carrier is required to verify the age of the recipient and will not leave packages containing alcohol without an adult signature and valid ID.
- We strongly recommend shipping to a business address where an adult is regularly available to sign for packages.
- If a shipment is returned to us because an adult signature could not be obtained after multiple delivery attempts, additional shipping charges may apply to re-ship the order, or a refund may be issued less original shipping costs and a restocking fee.
- Out-of-State Members and Shipping Restrictions
For members residing outside of California, please note the following:
- Shipping Legality: Amista Vineyards ships wine only to states where direct-to-consumer (DTC) wine shipments are permitted by law and where Amista Vineyards holds the necessary licenses and permits. Due to the complex and constantly evolving nature of state alcohol laws, we may not be able to ship to all states or to certain zip codes within a state.
- State-Specific Regulations: Your state of residence may impose additional restrictions on the quantity of wine you can receive, frequency of shipments, or require specific reporting. By joining, you acknowledge and agree that it’s your responsibility to understand and comply with all applicable laws regarding alcohol shipments in your state.
- Taxes: Applicable state and local sales taxes, as well as excise taxes, will be charged based on the shipping destination state’s laws. These will be clearly itemized on your invoice.
- Age Verification: All age verification and delivery requirements (Section 8) apply equally to all out-of-state shipments.
- Shipping Delays: During periods of extreme weather (hot or cold), we may delay shipments to certain states to protect the quality of your wine. You will be notified of any such delays.

- Taxes and Fee Changes
Applicable state and local sales taxes will be charged on all wine club orders.
- Notice of Fee Changes: In the event of any change to the fee charged for your wine club membership (including changes you may have previously consented to in an existing plan, if applicable), we will provide you with a clear and conspicuous notice of the fee change and information regarding how to cancel. This notice will be sent to you no less than seven (7) days and no more than thirty (30) days before the fee change takes effect. This notice will also include the amount or range of costs you will be charged and, if applicable, the frequency of those charges, unless you take timely steps to prevent or stop those charges.
- Prohibition of Misrepresentation
We will not misrepresent, expressly or by implication, any material fact related to the transaction, including but not limited to, the inclusion of an automatic renewal or continuous service, or any material fact related to the underlying wine club goods or services.
- Governing Law
These terms and conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
